Comments

  1. When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.
  2. An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

 

Cookies

  1. If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.
  2. If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.
  3. When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.
  4. If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.
 

Basic Terms

  1. Users must be at least 16 years old.
  2. Membership is limited to individuals registered for or who have completed a course with DPC.
  3. DPC reserves the right to disapprove inappropriate content.
  4. Users are accountable for activities under their account name.
  5. Users must keep their password secure.
  6. Members must maintain a respectful community environment.
  7. Compliance with local and international laws is essential.
  8. Responsibility for content submission lies solely with the user.
  9. Hacking or falsely associating websites with DPC is not permitted.
  10. Unauthorized API access is prohibited.
  11. Web scraping or caching DPC content is not allowed.
  12. Spamming other DPC members is not permitted.
  13. Use of web URLs in names requires prior approval.
  14. Malicious software transmission is prohibited.
  15. Violation of jurisdictional laws is unacceptable.
  16. Violations result in account termination.
 

General Conditions

  1. DPC may change or terminate services without notice.
  2. Terms may be amended; material changes will be notified.
  3. Service can be refused to anyone.
  4. Inactive or misleading usernames may be reclaimed.
  5. Content and accounts may be removed at our discretion.
  6. Trademarked usernames may be reclaimed.
 

Content and Licensing

  1. If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.
  2. DPC does not claim ownership rights over any text, files, images, videos, sounds, or any other materials (“Content”) you post through DPC.
  3. Members who post content affirm ownership of said content. By posting, you indemnify DPC against any third-party claims related to the content you’ve uploaded. Ownership remains with the individual who posted the content.
  4. Upon posting any Content on DPC, you grant DPC a non-exclusive, fully paid, royalty-free, global, limited license. This license allows DPC to use, modify, remove, augment, publicly perform, publicly display, reproduce, and translate said Content. This will be for purposes including but not limited to photography education and DPC advertising. Your copyright and/or authorship will be fully acknowledged, and DPC will not be required to make any payment for such uses.
 

Termination of License

  1. You can terminate this license at any time by deleting your content or account. However, backup copies may retain your content for technical reasons for a limited period, although it will not be visible to other users. Additionally, if you’ve shared content with others who have not deleted it, that content may continue to be displayed.
  2. By participating in DPC, you acknowledge DPC’s compliance with data protection regulations including the Protection of Personal Information Act (POPIA) in South Africa, the Data Protection Act in the UK, the General Data Protection Regulation (GDPR) in Europe, and relevant U.S. privacy laws.
 
 

Limitation of Liability

  1. Emails regarding Community Activities, Photographic Courses and Excursions may be sent to you.
  2. DPC may experience service interruptions.
  3. Content may be deleted for various reasons; backup your data.
  4. No warranties for uninterrupted, error-free service.
  5. Limited liability for lost profits and data.
 
 

Disputes Resolution

  1. Legal proceedings will occur in South African courts.
  2. Users indemnify DPC against third-party claims.
 
 

Other Provisions

  1. EU or UK residents can litigate in their home country.
  2. These terms constitute the full agreement.
  3. Unenforceable terms will not affect the remaining terms.
  4. Failure to enforce terms is not a waiver.
  5. Amendments must be written and signed.
  6. Rights and obligations are not transferable without consent.
  7. Terms are assignable by DPC in specific cases.
  8. Compliance with laws is mandatory.
  9. No third-party beneficiary rights are conferred.
  10. All ungranted rights are reserved.
  11. Compliance with all applicable laws is essential.
  12. DPC collects data as per the Privacy Policy.
  13. The Data Policy elaborates on data use.
  14. Community Standards dictate expected conduct.
  15. This document, or page form part of the overall agreement.
